Hogan Lovells succeeds before the TAR Lazio annulment of the PHV decree on return to the garage and the national rides database
5 August 2025 – Global law firm Hogan Lovells secured a favorable judgment in the interest of ANITRAV (the National Association of PHV service providers) before the Lazio Regional Administrative Court (TAR Lazio), obtaining the annulment of interministerial decree no. 226/2024. This decree, among other things, had introduced a minimum waiting time of 20 minutes for PHV rides and established a national database at the Ministry of the Interior containing data on all rides made on the national territory.
"The decision reaffirms the need for proportionality between regulation and innovation in local public transport, in order to eliminate the imbalance between taxis and PHV services," commented the Hogan Lovells team. "The ruling upheld our thesis that the minimum waiting time of at least 20 minutes between PHV rides was equivalent to de facto reintroducing, by administrative means, the obligation to return to the garage already declared unconstitutional with sentence 56/2020".
The Lazio Regional Administrative Court also recognized the legitimacy of using technological tools for bookings, such as apps, to ensure efficiency in the PHV service, excluding the possibility for the administration to introduce restrictive and unjustified measures.
