Patent Litigation

Patent Litigation

Our team of over 200 IP Litigators have steered the course in some of the largest global patent disputes. We can handle complex cross-border cases with one fully integrated international team. We regularly represent clients before the International Trade Commission (ITC), a U.S. District and Supreme Courts,  European national courts, the Unified Patent Court, Asian IP tribunals, and in international arbitration.

We have solid experience in enforcing patents, defending infringement claims, challenging patent claims, advising on patent strategies, patentability issues, cross-border patent licensing and acquisition deals. Most of our advice has a cross-border element and we are experienced in producing and implementing multi-jurisdictional enforcement and defense strategies as well as coordinating arguments in parallel proceedings.

We understand the technology behind our clients’ products and innovations. Many of our lawyers and patent attorneys have technical backgrounds and hold advanced degrees and PHDs in fields such as biology, bio-chemistry, physics, chemistry, electrical engineering, and computer science. Unlike many other firms we can handle infringement and nullity proceedings without the help of external patent attorneys or other scientists.

We are one of very few firms that has top-tier patent litigators in all major EU jurisdictions and the UK – we’ve been defending clients in cross-border European patent litigation since 2000 and are now one of the most active firms at the UPC. We are exceptionally well-positioned to guide clients through the challenges and opportunities which come with the Unitary Patent and the UPC system. We are also able to align UPC litigation with UK patent litigation or Spanish patent litigation with our own attorneys. We have a deep understanding of country-specific nuances, practices, judges, and procedures, that we can utilize when preparing a coordinated and effective pan-European strategy in a UPC litigation.

In addition to our deep understanding of handling cross-border disputes and Patent Office matters, we are equally experienced in conducting Freedom to Operate (FTO) analyses and negotiating license agreements.
