Max Blender advises Fortune 1000 companies, financial institutions, and corporate officers and directors on a variety of complex commercial disputes, before both state and federal court, including securities, derivative and other shareholder actions; M&A litigation; internal investigations and white collar criminal defense; sophisticated contractual disputes; litigation involving complex financial instruments and structured products; and bankruptcy litigation. He works closely with clients to assess risk, develop litigation strategy, and navigate issues involving significant financial exposure and reputational sensitivity. His practice focuses on helping clients resolve disputes efficiently where possible and positioning them for success when litigation becomes necessary.

Max is actively involved in all phases of litigation and arbitration, from drafting pleadings and dispositive motions to preparing trial and hearing materials in high-value disputes, including a nine-figure international arbitration. He manages key aspects of discovery, develops deposition and witness strategies, and conducts in-depth legal research to support case strategy.

Max also maintains an active pro bono practice representing clients in immigration proceedings.

Representative experience

Advising an insurance and asset management company and its Chief Executive Officer in civil RICO litigation in the Southern District of New York, winning reversal of an asset-freezing preliminary injunction before the Court of Appeals for the Second Circuit.
Advising the founder of a cryptocurrency exchange in District of Maryland litigation involving contested ownership and control, defeating a receiver motion and enforcing a settlement resulting in dismissal.
Representing a lithium mining company in a nine-figure ICDR arbitration, securing victory by defeating the claimant's nine-figure damages claim and limiting the award to nominal incidental damages.
