For close to 30 years, Mitch has represented pharmaceutical, biologics, and medical device manufacturers, universities, academic health centers, research institutes, and government contractors in a wide variety of complex government investigations and actions, involving issues arising under federal and state laws. He has defended clients in disputes arising under the False Claims Act; the Anti-Kickback Act; the Food, Drug, and Cosmetic Act; and state consumer protection laws. His experience encompasses internal, congressional, and GAO investigations; grand jury practice; and related civil litigation, including the defense of qui tam actions under the False Claims Act and state attorneys general consumer protection act statutes.
Prior to joining Hogan Lovells, Mitch was a trial attorney in the Civil Fraud Section of the Department of Justice. In that capacity, he investigated, litigated, and settled complex multimillion dollar civil False Claims Act matters, including numerous qui tam actions. Prior to law school, Mitch worked as a legislative assistant to Congressman Dean Gallo.
